The new Building Act No. 283/2021 Coll., which brought fundamental changes for property owners, entered into force on January 1, 2024. One of the key obligations that the seller must fulfill is to keep and, when transferring the property to the new owner, hand over the current project documentation of the construction.
A forgotten duty
Many sellers still do not realize that it is not enough to simply hand over the keys to the property - all documentation corresponding to the actual construction must also be included in the sale. However, failure to comply with this obligation can have unpleasant consequences, including a fine of up to CZK 400,000.
Real estate agents in particular are increasingly faced with the need to explain to clients that without appropriate plans, selling a property can be problematic. This obligation not only protects the buyer, but also clearly defines the conditions for future construction modifications or reconstructions.
How to fulfill this obligation without complications?
To facilitate the process of transferring information and help real estate agencies educate their clients, a template "Instruction of the seller on his obligation to have and transfer project documentation to the buyer" was created. This template can be easily placed on the real estate agent's website or handed over to clients in person or by email.
